We are parents with children at St Peter's Community Primary School, and are devastated that Brighton & Hove City Council (B&HCC) have approved an application for a 15m telecoms mast at Fishersgate Terrace, just 28 metres from school classrooms and playgrounds. Despite over 200 objections, from parents, residents, the Headmistress of the school, two Councilors and Peter Kyle MP,  plus two petitions, the council gave the go-ahead to this mast.

The potential short and long term health impacts of a mast so close to school classrooms and young children have been ignored. Children as young as 3 attend the nursery and can spend as long as 8 years at the school, so they could be exposed to high radio frequency radiation (RFR) on a regular basis for several years. The staff of the school and local residents living very close to the mast will also be exposed.

We believe the health implications of the mast were not properly taken into consideration, particularly given the changes to the height of the mast mid-way through the process. We also believe highway safety implications of the development were improperly ignored and that alternative sites could and should have been properly considered.

Our next step

Challenging a planning decision has a six week deadline. A judicial review application would have to made by 10th September. If B&HCC do not concede and rescind the decision by 2nd September an application for judicial review will become the only way of halting the mast.

If the dispute is resolved on 2nd September it will expose the frailty of the planning system ahead of the Government's proposed further deregulation.

If not, the judicial review will highlight the strength of feeling regarding the need for proper public health protection.  The case is likely to coincide with legislation being pursued through Parliament to achieve faster 5G rollout.

We are seeking funding nationally as the case exposes that planning policy is not working, and that public health will be less well protected if the Government give telecoms companies free-rein to place their masts wherever they choose.

We WON our case!

Dear Supporters,

We are delighted to announce the fantastic news that we have WON the judicial review case against Brighton & Hove City Council. They chose not to contest our claim and conceded. 

The High Court of Justice has QUASHED the decision made by Brighton and Hove City Council, resulting in the refusal of the original planning application. The telecoms company will not be able to appeal this decision because they did not object at the judicial review stage.

We are delighted by this result and wish to thank you all for your kind support.

Brighton & Hove City Council conceded on the following grounds:

The decision was unlawful for the following reasons:

(i)    the Council unlawfully determined that the highway safety implications of the cabinets and the concerns expressed by the Council’s highways team were not a relevant consideration;

(ii)    the Council failed to address the health impacts of this particular proposal and to obtain adequate evidence of the assessment of the proximity to the school and the amended proposal;

(iii)   the Council failed to consider whether the facility could be sited on an existing building or structure, the Interested Party having failed to provide any evidence on that matter.

Judicial Review Claim Filed!

Hi Everyone

Thank you to all of you who have kindly donated to our campaign so far and helped us reach our initial target of £6,000.

Harrison Grant, our solicitors, instructed barrister Richard Harwood OBE QC, and have filed the judicial review claim.

Brighton & Hove City Council (the Defendant) and Hutchison 3G UK Ltd (the Interested Party) now have until 6 October to file an acknowledgement of service indicating whether they wish to contest the claim and, if so, setting out their summary grounds for doing so.

We have extended our target to £40,000 so that we can raise sufficient funds to progress to a hearing, should Brighton and Hove Council not concede in the meantime.

We would appreciate everyone sharing the Crowd Justice page far and wide to help us achieve this target.  

Should the Council concede, if there are any excess funds after all the current expenses are paid, the funds will be donated to a related campaign.
