The Luke Mitchell Campaign urgently seeks your support to challenge a grave miscarriage of justice. We are raising funds to enable Luke’s new top-tier legal team to begin the preliminary work of retrieving case files and conducting an essential case review. This crucial first step will allow them to carefully assess the evidence and determine the best path forward, with the ultimate goal of taking the case back to the courts.
Background: The Case of HMA vs. Luke Muir Mitchell
In 2005, then-16-year-old Luke Mitchell was convicted of the murder of Jodi Jones in 2003. Over 21 years later, the evidence strongly suggests a serious miscarriage of justice has taken place. Luke was convicted wholly on circumstantial grounds. There was no forensic evidence linking him to the crime. While there were eyewitnesses, their testimony was unreliable due to flawed visual identification, and Luke couldn’t be positively identified in court.
Despite widespread public concern, efforts to uncover the truth have repeatedly faced obstruction.
Trial by Media: The Role of Sensationalist Coverage
For 10 months before Luke even stood trial, he was vilified in the press daily. Tabloid newspapers and broadcasters relentlessly insinuated he was guilty, frequently publishing biased, misleading, and prejudicial coverage. This media storm shaped public opinion and, crucially, tainted the Jury pool. Despite supposed legal safeguards, the intense and sustained trial-by-media denied Luke the fair trial to which every citizen is entitled.
The media’s conduct in this case did not inform — it inflamed and it was nothing short of horrifying
New Evidence Ignored
Notably, the SCCRC identified new DNA evidence on a key item of clothing related to the crime. This DNA sample was excluded as belonging to Luke, yet no further investigation was pursued to identify the true source. To this day, the owner of this DNA remains unknown, whilst Luke remains in prison.

Why Public Support is Crucial
The Scottish establishment has consistently resisted independent examination of Luke’s case. However, public pressure is growing: over 31,000 people have signed a petition demanding an independent review.

Key reasons why urgent action is needed:
- Destruction of Evidence: Following renewed interest from the 2021 Channel 5 documentary Murder in a Small Town, a police whistleblower revealed that Police Scotland began steps to destroy evidence related to the case. In 2022 over 90% of this crucial evidence was destroyed.
- Unexamined Forensic Evidence: Body fluid samples, including semen and sperm, remain in police custody but have never undergone modern DNA testing. Requests for access to conduct these scientifically advanced tests have been repeatedly blocked by Police Scotland and COPFS
These troubling facts raise a critical question: why are authorities avoiding the truth?
The Legal Challenge and Funding Needs
We are pleased to announce that a new top-tier criminal defence legal team is now preparing to begin the essential preliminary work of retrieving files and reviewing the case. However, to proceed, we must raise sufficient funds to cover the legal fees. If we don’t hit our target we can’t move forward.
While the Crown benefits from extensive public funding, legal aid in Scotland often fails to support those wrongly convicted— creating a significant financial barrier to justice.
