Residents of Ancells Farm, concerned about the recent planning decision allowing HGV's access through our community. Our aim is to protect the safety, well-being, and quality of life of residents.

We are reaching out to you with an urgent matter concerning the future of our community. As many of you are aware, a planning decision has been made to allow Heavy Goods Vehicles (HGVs) access through our residential area 24/7, despite significant objections and concerns raised by residents, consultees, and planning authorities.

We believe that this decision poses a serious threat to our community's quality of life, safety, and well-being. To challenge this decision and protect our rights as residents, we are embarking on a legal process known as a Judicial Review Application.

We have sought legal advice from Richard Buxton Solicitors, who specialize in Environmental, Planning, and Public Law. Based on their assessment, we have outlined the steps and estimated costs involved in this legal challenge:

The first step would be instructing counsel to advise on whether it is felt that there is indeed a case, or not. The total cost for this is £2,000-£2,500+VAT.

If it is established that there is indeed a case, the following steps would follow:

Stage 1 (Pre-Action Work): 1,600+VAT
Stage 2 (Lodging Claim): £5,000+VAT (assuming no Reply needed, no hard copy bundles)
Stages 3+4 (Assuming permission granted on papers, no renewal, 1-day hearing): £6,990+VAT

The rough global total estimated by our legal advisors is £16,090+VAT. However, unforeseen events may arise during the legal process, so a more realistic figure to work from would be around £20,000+VAT.

We understand that this is a significant financial commitment, and therefore believe we should initially proceed with instructing counsel to advise on whether it is felt that there is indeed a case, or not. The total cost for this is £2,000-£2,500+VAT.

Should the decision be made that we do have a case, we may look to reach the total target in order to proceed.

We are reaching out to our community for support in order to reach the first goal of. £2,000-£2,500+VAT. We have decided to set up this page to raise funds for the legal fees associated with the Judicial Review Application.
