We are local folk living in the caring, thriving community around Cumberland Street.

Macclesfield is a great place to live, a unique historic market town with fascinating heritage. We want to welcome new people to this area especially key workers buying Affordable Houses. We support a low density, low level residential development on this site that is respectful of current residents and with open space everybody can access, including visitors following the town’s Heritage Trail to listed and historic sites.

Under National policy and Local Plans Cheshire East Council (CEC) has responsibility to:

·        Protect OUR Heritage

·        Protect ALL residents’ privacy and parking

·        Make provision for Affordable Housing for OUR Key workers

·        Make green open spaces accessible to ALL Macclesfield residents

On 21st April 2021, the Council granted permission for the redevelopment of King’s School historic site despite:

·        Damage to the setting of the listed buildings through 'strident' and 'overpowering' new builds the Council’s Conservation Officer said rendered the scheme unacceptable

·        Provision of ONLY 12 affordable houses when it should be 36, justifying this with a viability statement that shows developer Hillcrest Homes anticipates over £4 million profit

·        Too many/too large houses, with inadequate privacy distances, impacting on privacy and adding to already serious parking and traffic problems for residents on Coare, Pownall, Tunnicliffe and neighbouring streets

With the support of Macclesfield Civic society and a heavy heart, when the decision noticed is issued, we will start legal proceedings in the form of a judicial review to challenge a decision taken contrary to the Local Plan and other National Policy.

To fund the initial legal work required to take this matter to Court, we must raise £6,000. This will cover the work of a solicitor to send the Council a pre-action letter (and instruct a barrister to assist with drafting the grounds of challenge), to consider any response, and then prepare the papers for filing at Court.

I hope you will support us in this challenge to bring light to the process by which CEC has arrived at its decision and potentially see it quashed by the Court. This is not the legacy that previous generations worked hard. The people of Macclesfield now and tomorrow expect excellence.

New developpers involved

For the last few weeks, local residents have been meeting with new developers and we are pleased with our discussions.

Thursday 17th March 2022 is the last day for filing for Judicial review and we have decided not to file and instead work with the developer as their proposals seems to meet many of our requests.

Though there are no guarantees, we have to trust that they will to stick to their word and that CEC will approve the modifications to plans. Watch this space for press releases.

Hillcrest has been mothballed

HILLCREST HAS BEEN MOTHBALLED.
We are not entirely sure what this means for us. This commentary is a regular feature by PlaceNorthWest, industry leading publication, who have written about Nikal and Hillcrest schemes previously.

OTHER SITES ARE BEING SOLD
King's School Cumberland street is a small site to Nikal. If small site redevelopment no longer fits their business model then maybe it will be sold to a new developer.

James Payne, brother of Nick, is no longer MD at Hillcrest, the housebuilding subsidiary. Hillcrest has been mothballed. Other sites are being sold

Working to deadlines

Thank you again for helping us achieve our first stage target. Much appreciated!

The crowd justice site now automatically renews the deadline date every 30 days so please ignore the current deadline on the site.

OUR next deadline is when CEC issue their Decision Notice. We then submit our pre-application letter (also called Letter before claim) in which we give details of the issue in dispute and establish whether litigation can be avoided,  which obviously would be our preferred outcome.

If anyone would like to see more details about solicitor fees or the letter, please just contact me on [email protected]

Good news from solicitor!

Thank you for all your support!

We have been busy speaking to our solicitor and good news. The case appears to be relatively straightforward and because the we have done much of the preparatory work of pulling together the evidence, the first stage fees have been substantially lowered.

We are lowering the initial target to £2500.

There is currently no Decision Notice. We can only start proceedings once it is issued. We will therefore be extending the deadline for raising money for the next stages.
