For patients' sake, help change NHS blacklisting practices!
This is me:
My name is Anthony (Tony) Adams. I am a father of three, husband and a doctor. I am of Afro-Caribbean descent, emigrating from the Caribbean in 1979 to be with my mother, who came to the UK in the 1960s (now a retired senior midwife). I graduated in 1988 with an MBBS from St George’s Medical School, University of London.
I undertook postgraduate training in London in General Surgery and Emergency Medicine and obtained the FRCS by examination (in general surgery) from the Royal College of Surgeons of Edinburgh in 1994 and completed my training in Emergency Medicine in October 1999 after obtaining the FRCEM. I am on the Specialist Register.
What happened to me:
Until February 2012, I had an unblemished disciplinary record. My then NHS employer summarily dismissed me from my consultant post in Emergency Medicine after I raised concerns about bullying behaviour that was affecting my ability to do my job. I was referred to the GMC, who, after their initial assessment of the facts, concluded that there was no case to answer against me and there was no need for action on my registration.
Since my dismissal I’ve been unable to secure a substantive consultant post within the NHS, despite significant staff shortages within my speciality.
I am being prevented from giving the full benefit of my training and experience to patients and other healthcare workers because I've been blacklisted after being unfairly dismissed. Why?
I need help to fund my case, as I have now exhausted all savings and funds available to me through insurance and need urgently to raise £5K to take my case to the Employment Tribunal.
My legal case:
My current case before the Employment Tribunal is for Post-Termination Victimisation against the dismissing NHS Foundation Trust and other specified NHS Trusts. This is based on the case in Jessemey v Rowstock [2014] EWCA Civ 185 and evidenced by information received from Data Subject Access Requests (DSAR) made to various NHS Trusts, where I had either been previously employed as a locum, or had been unsuccessful at interview for substantive posts despite having the requisite skills and experience.
It is now obvious that I am being actively prevented from obtaining a substantive consultant post without justification.
Why I am fundraising:
I am supported by an excellent legal team at Bindmans LLP and my case is scheduled for a 10 day hearing. I cannot do it on my own.
My case highlights the need for urgent review of NHS workforce policies and practices. Furthermore, the public deserves an explanation as to why they are being told that there are shortages of experienced staff, when in fact some of those who can work are being refused work. Whom does blacklisting serve and to what end?
We need to raise £5, 000 to cover the costs of my legal team.
Funds raised on CrowdJustice do not come to me personally, but go directly to my lawyer’s client account to cover the cost of funding my case.
