Moores requires assistance in;
- (required) forming an application to Appeal a Strike Out.
- (ideally) counsel to represent Moores at hearing(s).
The Appeal to Strike Out would be made on the following terms;
- In the hearing 18 September 2025, the Court proposed that Moores (Claimant) pay Greater Manchester Police's (Defendant) costs in forming a Defence against Moores's claim.
- On failing to accept this proposal, the Court then Struck Moores's claim out through 'lack of focus'.
- There is a conflict in that the Court would accept the Claimants Particulars of Claim if the Claimant agreed to pay the Defendants costs in forming a Defence to it.
- The appeal is made on grounds;
- In the hearing 18th September 2025 in the County Court at Manchester - the Court proposed that the Claimant pay the Defendants Costs. In making this proposal, the Court accepted that the Claimants PoC was coherent, otherwise the proposal would not and could not have been made.
- The Court cannot Strike Out the PoC (dated 31 JANUARY 2025) on discretionary grounds that the Claimants Particulars of Claim was 'incoherent and lacking in focus' when it had previously made the Claimant an offer that would have inferred the Defendant to respond to that Particulars of Claim. The proposal made by the Court in the 18 September 2025 hearing infers coherency in the PoC. This conflicts with the reason given to Strike Out the Claimants claim.
- The Court cannot Strike Out the Application for Interim Remedy (dated 17 SEPTEMBER 2025) where no oral or written account was given in determining how the Court came to the decision to Strike Out that Application.
- In the hearing 18th September 2025 in the County Court at Manchester - the Court proposed that the Claimant pay the Defendants Costs. In making this proposal, the Court accepted that the Claimants PoC was coherent, otherwise the proposal would not and could not have been made.
