Defend Parrs Lane: Support Our Challenge to the Wain Homes Develop
A major housing development has been approved on land to the east of Prescot Road in Aughton, immediately adjoining existing homes along Parrs Lane.
The development, proposed by Wain Homes, involves 122 new homes, associated infrastructure and access arrangements, including a secondary access from Parrs Lane. Planning permission was granted by the planning committee in September 2026.
For those of us who live alongside the site, this is not simply another housing development. It will have a direct and lasting impact on our homes, the character of the area, traffic, drainage, highways, the local environment and the surrounding community.
Why are we raising funds?
We believe there are legitimate grounds that need to be properly examined by specialist planning and public law solicitors.
We are therefore raising funds to obtain specialist legal advice and, if appropriate, bring a Judicial Review challenge to the planning decision.
A Judicial Review is not an opportunity to simply disagree with a planning decision. It is a legal process through which the lawfulness of the decision-making process can be examined.
We need specialist solicitors and barristers to review the planning process, the committee’s decision, the evidence relied upon and the relevant planning and legal framework, and to advise whether there are grounds for a challenge.
Why this matters to Parrs Lane
The approved scheme is substantial. The council’s planning report describes the application site as approximately 5.6 hectares, comprising an open field to the east of Prescot Road, with the site lying to the north of existing dwellings along Parrs Lane.
The scheme includes 122 homes and associated works, with the principal access from Prescot Road and a secondary access from Parrs Lane.
The planning application itself attracted representations from local residents and community organisations on matters including highways, drainage, residential amenity, ecology and other planning considerations.
We are not asking people to take our word for it. We want qualified independent legal professionals to examine the decision and establish whether the proper legal and planning processes have been followed.
What will your donation fund?
Funds raised will be used towards:
- Specialist planning and public law solicitor fees
- Legal advice regarding the planning decision
- Reviewing the planning documents and decision-making process
- Obtaining specialist advice where necessary
- Counsel’s advice, if appropriate
- The costs associated with bringing a Judicial Review, should lawyers advise that there are proper grounds to do so
Any legal action will only be pursued following advice from appropriately qualified legal professionals.
We need your help
The opportunity to challenge a planning decision through the courts is subject to strict legal procedures and time limits.
We therefore need to act quickly to obtain specialist advice and establish the appropriate next steps.
This is about giving local residents the opportunity to have the decision independently scrutinised through the proper legal process.
If you live on Parrs Lane, Prescot Road, Orchard View or in the surrounding area, or simply believe that important planning decisions should be properly scrutinised, please consider contributing.
Every contribution, whatever the amount, will help us obtain the specialist advice needed to determine whether a legal challenge can proceed.
Please donate and share this page with your friends, neighbours and local community.
