Who are we? 

Clean Air for Southall and Hayes (CASH) is a campaign group, whose objective, is for enforcement action to be taken against Berkeley Group, the site developer of Southall Waterside, formerly Southall Gasworks.

Summary 

Our aim is to instruct a team of specialist environmental lawyers and barristers, to pursue a public nuisance claim against Berkeley Group. Public nuisance is both a criminal offence and a civil action in tort. It also involves substantial breaches of environmental law. Ealing Council and The Environment Agency could also be the subject of legal action.

What are we trying to achieve? 

Residents in Southall are experiencing an unacceptable level of air pollution, as a result of soil excavation and remediation. Many residents are experiencing coughing, nausea, headaches, asthma, nasal, throat and eye irritation which they are linking to the pungent petrol/tar like odour form the site.  The site is known to contain volatile organic compounds (VOCs), including benzene and naphthalene.  Benzene is a known carcinogen and naphthalene is possibly carcinogenic. We want a cessation to the odour nuisance, which is blighting the lives of many in Southall, through legal action as neither The Environment Agency or Ealing Council have found reason, despite multiple complaints, to undertake enforcement action against Berkeley Group.

What is the next step in the case? 

CASH has instructed some of the leading lawyers in the UK, who specialise in environmental law, to take immediate and urgent legal action to stop the ongoing poisoning of the local community in Southall, by highly toxic contaminated land, being developed by Berkeley Group. We want to bring an action for major breaches of environmental law and public nuisance and obtain compensation for innocent families, whose health has been damaged by the noxious odours, spread by the developer. 

To do this, we desperately need support from the public and people, who care about environmental pollution and the callous treatment of ordinary men, women and children who don't have the funds to defend themselves. The monies raised, will cover our legal costs, including the obtaining of real evidence to prove that the health of the community has been seriously impaired by the dangerous chemicals, released by the developer's actions.  All funds raised will be held safely and securely in the accounts of our solicitors and used solely for pursuing our legal action.

How much we are raising and why? 

Our target is a minimum of £25,000.

Our glass is half full but it needs to be topped up!

Dear Supporter

We need your help, to reach our £10,000 target.  We are just over half way but until we get there, legal action won't start.  The campaign has been very active on the streets and held a joint CASH/Extinction Rebellion Die In on 14th September, outside Ealing Town Hall, which has gone a long way to increasing awareness of our campaign.
