TransLucent.org.uk is a Trans led Advocacy and Human Rights Organisation working for the Transgender and Gender Diverse Community in the UK.

TransLucent are considering legal action against the EHRC because we believe that the EHRC may have pre-determined the outcome of a consultation on the impacts of the Supreme Court Judgement on 16th April 2025. 

The speed of issue of the "Interim Update" on the 25th April 2025, statements made within it and the very short (two-week) consultation period (mid May 2025) raise significant concerns of the ability of all stakeholders and interested groups to have sufficient and proper input into the amendments being considered. 

TransLucent are also very concerned that the public statements already made by the EHRC’s Chair, Baroness Falkner, and one of its Commissioners, Akua Reindorf, could lead others to believe the changes are already in place and mandatory. This belief could place employers and others at risk of legal action.

We are raising money to cover initial costs and later of any judicial review case for us to take action against the EHRC to ensure guidance is properly considered. We need your support: please contribute and share this page now!

We are asking the EHRC to withdraw the existing interim update, and for a FULL and proper, timely twelve week consultation to be allocated, and for a full, proper and independent review of the consultation responses to be undertaken before any new or amended guidance is published.  

Our lawyers sent a legal letter to the EHRC on Monday 12th May. TransLucent plans to take further legal action unless we get a satisfactory response.

TransLucent is raising £60,000 to cover court and legal fees for the action. Any monies raised are sent directly to our lawyers. We need to raise £10,000 in the first instance to cover the risk that we would need to pay the EHRC’s costs if we lose any judicial review. Any remaining money will go towards our lawyers’ fees and court fees. Our lawyers are acting at heavily discounted rates. 

Any money which we don’t end up needing for our legal case will go to other legal cases supporting trans rights.
