Imagine if your dog got lost and ended up with someone who refused to give your dog back to you. Imagine that you did everything you could to get him back, but nothing you did worked. Imagine that you went to police and even the news, and still the person who had your dog refused to give him back. Imagine how heartbreaking and maddening it would be!

That's exactly what has happened here, and we need your help to get a beloved dog out of the hands of the person who has him and back into the arms of his heartbroken family.

In late November of 2017, Mikey the Bulldog went to visit his uncle Jordy in Phoenix, Arizona. On December 8, 2017, Mikey got out when a door didn't latch, and wandered down the street. 

He didn't get far. A nice couple, the Lintons, found him the same day, less than 1/4 of a mile from his home. The Lintons cared for him for about two weeks - until they had to seek a temporary foster home for him. 

On December 21, 2017, the Lintons passed Mikey to a woman who offered him a forever home, but also promised to return him if his owners were found. However, instead of helping look for the dog's owners, the woman tried to sell Mikey for $800! This occurred on December 26, 2017, only five days after Mikey had been passed to her. 

Then,  when Mikey's real family was finally found on December 27, 2017, the same woman refused to return him to his family. In fact, the day after Mikey's real owners were found and reached out to her, the woman rushed to have Mikey microchipped in her name. She did this on December 28, 2017. 

We've done everything we could think of to get Mikey back, including trying to negotiate with the woman. We even offered to pay the lady $800 for Mikey, and also offered to do a DNA test, but she refused. We offered to give her money so that she could buy her own bulldog, but she still refused to give Mikey back to his family.  She has even refused to allow Mikey's family see him at all, and also refused to return Mikey to the couple who found him. All Mikey's family wanted was to be able to see him and to call his name, in order to prove to the lady who has Mikey that he belongs to them, but the lady who has Mikey refused to let them see him.

Remember, the woman who has Mikey had only had Mikey for a week when his real owners were found! It's now been three months, and during that time we've done everything we can to get Mikey home! We even went to both the police and the media! We also started a petition, and more than 1500 people from around the world signed the petition to get Mikey home. 

Sadly, none of our efforts so far have resulted in Mikey being reunited with his family. It's now been three months since Mikey was passed to the woman who has him, and Mikey's family is understandably heartbroken and devastated.

Mikey's real family has plenty of proof that Mikey belongs to them. First, remember that Mikey was lost and found on the same day less than 1/4 mile apart. But they also have a puppy contract, their receipt from when they bought Mikey, vaccination records, breed registration documents, and plenty of photographs and videos. The photographs and videos they have look just like the dog in photographs and videos made by the lady who has Mikey, as well as the news footage from when the news interviewed her about Mikey!

At this point the only way to get Mikey home to his family is to go to court. We feel strongly that we will prevail in court, because all of the facts in this matter point to the dog in this woman's custody being Mikey the Bulldog, and, under the law, Mikey the Bulldog belongs to his family. 

Also, based on news footage in this matter, we and other bulldog owners worry that Mikey is not doing well in his current situation. It appears that he is suffering from severe allergies, and he also looks very sad. In addition, bulldogs can't survive outdoors in Phoenix, Arizona heat, and we believe that Mikey may be kept outside for much or part of the time. Temperatures in Phoenix, Arizona can reach 120 degrees, and often temperatures don't drop under 95-100 degrees for weeks at a time. Thus, it is urgent to get Mikey home to his family as quickly as possible, and certainly before summer comes! 

Unfortunately, in Maricopa County, Arizona, small claims courts can't order property returned to the owner - they can only issue monetary judgements. Because Mikey's family doesn't want money (they want their beloved dog back), we have to file a civil claim in Maricopa County Superior Court - which requires a lawyer and a fair amount of money. Costs are estimated to be between $5,000 and $7,500 (and possibly more).

We've already  hired a lawyer, and are now raising funds to cover legal costs of getting Mikey home. I personally paid the first $2,500, and am now reaching out to the dog community worldwide to help raise the remainder of the funds needed to get justice for Mikey the Bulldog.

Per crowd justice.com policy, all funds donated via this site go directly to the attorney - so you can be assured that your donation will go only towards the legal costs to get Mikey home. Crowd Justice has the attorney name and contact information, and has confirmed that the attorney has been retained and is handling this matter.

Again, please imagine what you would do to get your dog home if your dog was being held by a third party that refused to return him. I'm sure your answer is the same as mine - you'd do anything to get your baby home.

We Still Need Your Help

The case for Mikey has been filed in Maricopa County Superior Court. It was filed on March 29, 2018. 

Donations in this matter are just over $2,500 - legal expenses in this matter have exceeded $5,000 (and, including prior expenses, are well over $7,000 at this point).

So far, the opposing party has effectively avoided service. Although a party posted on a certain page that they went to Mikey's attorney to sign for service, this is not true. We confirmed with Mikey's attorney that when the process server first went to the house, a male answered claiming the person who has Mikey never lived there. After that, no one answered the door. Then, a person claiming to represent the person that has Mikey called Mikey's attorney stating they would come to sign for service, but no one ever showed up. 

At this point, the folks on Mikey's team  and Mikey's owners are experiencing horrific bullying, intimidation, and threats. At least one person has received death threats, and many volunteers, as well as Mikey's owners, are being terrorized via defamation, false allegations, and both direct and implied threats.

This is not a joke. This is not a lie. As God is our witness, this is the truth. 

We believe that the people committing the above acts are attempting to intimidate the owners and volunteers into dropping the lawsuit for Mikey's return. 

We don't believe this should be legal or allowed, and it may seem unbelievable (it is unbelievable to us too), but it is happening and we need your help to stop it.

Many of you have witnessed the defamatory and inappropriate content posted on a certain page, or been contacted by the same people directly.

We need your help. Please report any cyberbullying, defamation, harassment and/or threats you have experienced or witnessed to both Facebook and to the police and to other appropriate parties.

All we are trying to do is help a dog. All Mikey's family wanted was their beloved dog back. No one deserves what is being done right now. 

We couldn't get this far without you, and we can't keep moving forward without you. 

Please report all harassment, defamation, abuse, and threats to the appropriate police department and to Facebook and to any other appropriate organization.

May 2018 Update

We just sent an email to Mikey's donors. We will continue to update all donors via emails.

Service, Service, and More Service

We just spoke with Mikey's attorney.  

He confirmed that when the process server went to the address in question, the person answering the door advised that he had just moved there and had never heard of the person who has Mikey. After that, each time the process server showed up, no one answered the door.

The attorney also advised that someone had contacted him advising that the person who has Mikey was going to come to his office to sign for service, but no one ever showed up to do so. This was confirmed by the attorney himself on Wednesday, May 2, 2018. 

No one ever appeared at the attorney office to accept service. 

Therefore, service has not taken place.

CURRENT STATUS

Again, attorneys have advised us to remove Facebook pages, which is why we are removing Facebook pages at this time. Like any other legal matter, it is better to be quiet and allow the attorneys and court system resolve this matter.

We have had serious issues with volunteers and Mikey's owners suffering from harassment and intimidation - from things as benign as hang up calls to matters as serious as written death threats. 

In light of this, we are seeking a local advocate or rescue group will step up and take over the public functions of the case.

All monies have been paid directly to the attorney in this matter. At the conclusion of this case, any remaining funds will be returned to donors, in order of donation. Thus, the first to donate will receive their donations back first, and so on.

Lori Mansell, who donated the first $2,500 of the legal costs in this matter out of her own pocket, will not be reimbursed - at her own request.

We will also post receipts and/or make them available to all donors, showing what was paid to the attorney in this matter and what portion of that has been used  - we will do so at the conclusion of this case.

Again, at this time, we have been advised to remain quiet about the facts of the case.

Why We Filed a Civil Claim

Just wanted to remind donors that on 1/15/18, after closing this case on 1/8/18 as a civil matter, the Phoenix Police Department emailed Mikey's owner America Peralta Hernandez to file a claim in civil court. 

That is when we decided to move forward with a civil claim. 

This is documented in the police report obtained on 1/31/18 and in an email to the dog's owner. We filed the civil claim at the recommendation of the Phoenix Police Department, after they closed the matter, stating it was civil. 

That email stated (verbatim):

"Please follow the process that I recommended and file a petition so the case can be resolved in civil court. Thank You."

This email was signed by the detective handling the matter.

My Breeder is Behind This Effort

Dear Friends,

I wanted you to know that my breeder, the person who my dad Jordy bought me from in December 2015, is behind the effort to get me back home. She remembers me and she remembers Jordy. She has pictures of me, my mom, my dad, and my doggie brothers and sisters. I look just like them! 

All these stories by the other side about breeds or that I'm a different dog are wrong. I look like my mommy, I look like my daddy, and I look like my siblings. And we will show the court pictures and have the breeder testify in court to the same.

We only have about a week to raise the last $1,000 we need to get me home. Please help us raise the last of my legal fees today! 

Although we can't post photos here, Lori posted photos from the Maricopa County Superior Court site on my Facebook page, along with portions of the civil suit. My suit was officially filed on March 29, 2018. Please contact Lori if you have any questions at all.

8 Days Left

We have only 8 days to raise the final $1000 needed for this case to move forward through the court system. Your pledges have not been finalized at this time, and will not be charged if we don't reach our $2,500 goal by April 25, 2018. Hoping against hope we can raise the final $1000 needed to move forward. 

Please note that total legal costs for attorney Michael Gerity are $5,000.  Lori Mansell paid the first $2,500 out of her own pocket. This fundraiser represents the second half of the total legal fees, and Lori Mansell also pledged $25 toward those fees.

Overwhelming Proof of Ownership

The Peraltas have the following proof of ownership of the dog in possession of NE, and it is overwhelming!

1) Puppy contract, dated 12/08/2014.
2) Purchase contract, dated 12/08/2014.
3) Receipt for deposit, dated 12/08/2014.
4) Vaccination record, dated from 2015 to 2016.
5) Breed certification/registration in their name.
6) Parentage certificate.
7) Their breeder can confirm purchase, is willing to testify, and still owns dog very similar to Mikey.

8) Photos dated and posted on Facebook dated prior to December 8, 2018.
9) Videos dated and posted on Facebook dated prior to December 8, 2018.
10) Messages sent by Jordy Peralta to Mark Linton and Lori Mansell claiming and identifying the dog after seeing the dog on Facebook posts - and witnesses to the same.
11) Eyewitnesses familiar with Mikey and who know the Peraltas and can identify Mikey as the dog owned by the Peraltas.
12) The Lintons, who can identify the dog they passed to NE on or about 12/21/2017, appearance as required, notarized statements & testimony.
13) The fact that Mikey was lost and "Rhino" was found on the same day less than 1/4 mile apart - or less than 1/4 mile from the Peralta's home in Phoenix, map attached.
14) The fact that both dogs are male, purebred English Bulldog, unneutered, and not microchipped, factual.
15) The fact that both dogs are the same size, color, approximate weight, and have almost identical markings, factual.
16) The fact that the Peraltas filed at least two different police reports in an effort to recover Mikey, and can present those in court.  No one would file police reports to recover a dog that wasn't theirs.
17) The fact that they called, texted, and messaged NE asking her to return their dog to them, that at least some of those communications are preserved and can be presented in court.
18) The fact that they repeatedly offered an independent veterinary exam and DNA test, which NE refused.
19) The fact that when NE purportedly advertised the dog for rehoming on Facebook on or about 12/26/2017, she included a photo of the dog which was identified by the Lintons as the dog passed to NE on or about 12/21/2017, and also identified by the Peraltats as their dog, Mikey. In this "rehoming ad," the person posting in the 12/26/2017 Facebook ad on Straydar states that the dog is "three-years-old".
20) The fact that both the Lintons and Peraltas sent demand letters to NE to which NE did not respond.
21) The fact that they twice offered to meet NE to provide proof of ownership and identify their dog, which NE refused, NE's written declination to attend that meeting.
22) Communications from NE to multiple third parties, in which she states she will not meet the owners or return the dog.
23) The fact that two different attorneys were retained to assist in recovering Mikey, and so far NE has not responded to either attorney, factual and undisputed. No one would go to the time and expense to recover a dog that was not theirs.
The fact that a civil claim was filed in this matter. No one would go to the time and expense to recover a dog that was not theirs.
24) The fact that the dog in the ABC15 news footage, the dog in the video produced by NE on or about 01/08/2018, and the dog in videos produced by the Peraltas before Mikey was lost all look identical. Photos, video, and dog model as well as collages and drawings to follow.
25) We have consulted with several bulldog experts, and are confident that expert testimony can be obtained stating that the dogs are indeed one and the same, as necessary.
26) A blood testosterone test can offer evidence of the actual age of the dog in possession of Mikey, as necessary.
27) An examination by an independent veterinarian and dental specialist unconnected to either party will estimate his age as a young adult dog, as necessary.
28) A DNA test may be performed if necessary, as necessary.
29) A bloodhound tracking dog can be procured to smell Mikey's toys/blankets/hair and then "track" that smell to "Rhino," as necessary.
30) Additional evidence as procured.
31) The Craigslist ad posted by the Peraltas on 12/8/17.
32) The Peraltas Facebook messages claiming their dog on 12/26/17.

The case has been filed, we've halfway there!

First, thanks again for supporting Mikey's long road home.

Mikey has his own Facebook page called Bringing Mikey the Bulldog Home. He's been on the news. He has a private Facebook group called Mission Mikey. He even has his own video. 

And he has a lawyer. And his court case is filed in Superior Court in Maricopa County in Phoenix, Arizona!

But the folks who have Mikey are fighting really hard to keep him from going home! They are viciously attacking the rescuers trying to help Mikey's family get home!

We need everyone's help to get him home. We're almost there. Won't you help us?

Mikey's claim has been filed with the court.

Mikey's claim has been filed with the court. We have raised 9% of the funds needed to finish paying Mikey's legal costs. 

So far, we've had 21 donors contribute a total of $1205, since we first started raising money for Mikey in January 2018. This is it. This is the total that has been raised.

Mikey's legal expenses so far have been $4,185. That is $1685 to his original attorney and $2,500 to his second attorney. Receipts for those legal costs have already been posted on Mikey's Facebook pages and groups

Lori Mansell has covered the difference of $2,980 out of her own pocket.

We still need to raise $2280 to cover Mikey's full legal fees - that doesn't include what's already been paid. All money donated here goes straight to Mikey's attorney - no one else ever touches or sees it.

Lawsuits are very expensive, there's no way around it!

So please donate and/or share today!

If every member of the group donated $7, we'd have enough to cover all of Mikey's legal fees.

We did try to locate a pro bono attorney, but were unable to find any attorney who would handle this case pro bono. We are getting a discounted rate, but lawsuits are still expensive. 

We are asking the court to award attorney fees and penalties, and if we receive an award by the judge and are able to collect it from the folks who have Mikey, I personally guarantee that we will refund all donations to every donor.
